Which country did you buy your phone in? I've read of several users here who have returned their phones after more than 7 days, so I'm not sure why you would have a different experience unless you ordered from a different country from them which may have different terms.

I purchased from Nokia USA.

If you go to the Nokia USA site, they clearly state their return policy as follows:

"Our 30-day Satisfaction Guarantee and our 7-day Money Back Guarantee allow you to return equipment purchased online within the timeframe of the guarantee. A15% restocking fee will apply to all returns, other than product that is deemed as defective."

So unfortunately it does seem that the Money Back Guarantee clearly states 7-days, it is ambiguous what their 30-day Satisfaction Guarantee provides for.

If you haven't been, I would take a constructive approach as opposed to being demanding and ask to speak to a supervisor instead of just the call-center operators that pick up the call.

Supervisors usually have better training and I've found from personal experience that you can get further and more reasonable responses from them.

Good luck.

So you made a decision to purchase off the internet before release, you weren't happy with that decision so you expect nokia to bend over ?

It's funny with society today they aren't willing to take responsibility for their own actions.

Spot on. I didn't buy my N97 without trying it first. Would you buy a car you had never driven, then take it back expecting a refund just because you didn't like it?

I purchased mine on the phone with Nokia sales. I asked what the policy for return was and the rep. told me 7 days for full refund. I assumed the risk to go ahead and get the N97 and have been happy with the swap from iphone 3G. While 7 days is a short timeframe to decide if you are not happy, I was extremely picky to try all of the features possible the first few days.... The options are to sell it on EBAY/Craig's list and hope you get a somewhat good return on your investment (not too much of a loss).

Hi - I have returned my N97 to Nokia as I felt the hinge was too loose. I returned it here in the UK but just after 7 days. The Nokia UK website quotes a 14 day 'cooling off' period. It seemed to work for me - I called up, said I wanted to return and they gave me a Returns Code and sent me the details via e-mail. One thing though, I did asked for a replacement.

Separately though I did check that I still had a similar 'cooling off' period for the new phone and a customer service rep phoned me back and confirmed that I did - I've kept the voice mail, just in case.....

Guess this won't help anyone outside the UK though??

In the US, only two places allow you to try the N97 -- the Nokia flagship stores in New York or Chicago. If you live outside of these areas then you're only choice is to order from Nokia USA and pray that you like the phone. I ordered my N97 and within 7 days I called and requested to return the phone. I was told that only one person handles return requests in the US and I would have to wait for my authorization number. It took 3 weeks to get.

I miss the N97 at times but needed a phone for now, not what it can do in the future with updates. So for the time being I'm using the iPhone until Nokia releases enough updates to the phone and I'll buy the phone then.
